What is the CLARITY Act?

The CLARITY Act (H.R. 3633, the Digital Asset Market Clarity Act) is a US bill to divide oversight of crypto between the SEC and the CFTC. It passed the House in July 2025, but on September 15, 2026 the Senate rejected a motion to begin debate on it, 49 to 50. It has not become law.

What it means for you

Until a law like this passes, US crypto oversight rests on existing securities and commodities law, applied case by case by regulators and courts. A bill's name says what its sponsors intend; only an enacted law changes the rules.

How it works

The House passed H.R. 3633 on July 17, 2025 by 294 votes to 134. The Senate's description says it provides for a system of regulation of the offer and sale of digital commodities by the SEC and the CFTC, bars Federal Reserve banks from offering certain products or services directly to individuals, and prohibits using a central bank digital currency for monetary policy. On September 15, 2026 the Senate voted 49 to 50 against cloture on the motion to proceed to the bill, short of the 60 votes needed.
